Terms of Service: Design Services & Shop Purchases

These terms explain the separate rules for commissioned graphic design services and ready-made digital products purchased from the SEKAI Designs shop. By approving a proposal, commissioning work, or placing a shop order, you agree to the section that applies to that purchase. Nothing in these terms limits rights that cannot legally be excluded.

Part 1 — Graphic Design Services

This section applies to custom branding, graphic design, packaging, web design, 3D, and other commissioned creative services described in a written proposal, estimate, or project brief.

Proposals, scope and payment

The agreed proposal or written brief defines the deliverables, schedule, included revisions, price, and payment stages. Unless the proposal states otherwise, a 50% deposit is required before work begins and the final balance is due before final high-resolution or editable files are released. Extra concepts, major direction changes, or work outside the agreed scope may require a separate estimate or change order.

Client responsibilities and approvals

The client must provide accurate copy, assets, specifications, permissions, and timely feedback. The client is responsible for proofreading and approving names, copy, dimensions, colors, and final artwork before release or production. Supplier proofs and technical requirements should be checked directly with the relevant printer, manufacturer, platform, or developer.

Revisions, delays and inactivity

Revision rounds are limited to those stated in the proposal and are intended to refine the selected direction. New concepts or substantial changes may be billed separately. Timelines may move when content, approvals, or feedback arrive late. A project with no client response for 30 consecutive days may be paused or closed; restarting it may require a revised schedule and fee.

Cancellation and refunds

If the client cancels before work begins, any refund will be assessed after payment-processing and administrative costs. Once work begins, payments already made cover reserved time and completed work and are generally non-refundable, subject to applicable law and the written proposal. If SEKAI Designs ends a project without client breach, fees for work not performed will be addressed fairly.

Ownership and working files

Rights in final approved deliverables transfer only as stated in the proposal and after full payment. Unless expressly included, preliminary ideas, rejected concepts, working files, production methods, tools, and unused variations remain the property of SEKAI Designs. Third-party fonts, stock assets, software, plugins, and other licensed materials remain subject to their own licenses.

Originality and professional conduct

Requests to copy protected work or infringe another party’s rights may be refused. Either party may end the engagement for serious breach or abusive conduct. The financial and delivery consequences will follow the proposal, work completed, and applicable law.

Part 2 — Shop Purchases

This section applies to ready-made downloadable products sold through the SEKAI Designs shop, including branding starter kits, templates, graphics, digital assets, and add-ons.

Digital products and delivery

Shop products are digital downloads; no physical item is shipped unless a listing expressly says otherwise. Following successful payment, WooCommerce may provide access on the order confirmation page, by email, and through My Account when an account is used. Buyers are responsible for providing a working email address and saving a secure backup of purchased files.

What the listing includes

Each product page controls what is included. Preview images may show mockups, sample names, sample photography, or contextual scenes that are not part of the download. Software, subscriptions, printing, manufacturing, product photography, custom strategy, and exclusive design rights are included only when the listing expressly says so.

Personalized kit files

When a branding kit offers a brand-name field, the entered name is applied only to the file types and templates identified on the product page. Original AI, PSD, PDF, source assets, slogans, photographs, handles, and unsupported layouts remain unchanged unless the listing says otherwise. Buyers must check spelling and punctuation before ordering. Automated personalization is a convenience and is not the same as a custom or exclusive branding service.

License and permitted use

Unless a product-specific license says otherwise, a branding kit purchase grants one buyer a non-exclusive, non-transferable commercial license for one brand or one client brand. The buyer may edit the files and use the resulting branding in that brand’s marketing and business materials. The underlying templates, source files, logos, and assets may not be resold, sublicensed, shared, redistributed, offered as templates, or uploaded to stock or print-on-demand marketplaces as standalone assets.

Non-exclusive designs and custom services

Ready-made kit artwork may be sold to more than one buyer. Purchasing a kit does not reserve the design, transfer copyright in the underlying template, or grant trademark clearance. Buyers who need exclusivity, trademark research, strategy, or a fully custom identity should request a separate professional design proposal before purchase.

Software and compatibility

Required formats and recommended editors are listed on each product page. Buyers are responsible for checking software, font, operating-system, and technical compatibility before purchase. Photopea or Vectorpea may open supported files, but imported fonts, effects, Smart Objects, or advanced features can vary. Third-party software and services are governed by their own terms.

Refunds, cancellation rights and defective files

Because digital files can be accessed or downloaded immediately, change-of-mind refunds are generally not offered after access begins. This does not limit any mandatory consumer right. If a download is missing, corrupted, materially different from its description, or cannot be accessed, contact SEKAI Designs with the order details so the file can be replaced, access restored, or another remedy provided as required by applicable law. Any legally required consent concerning immediate digital delivery and withdrawal rights applies at checkout.

Prices, taxes and payment

Prices are shown in the currency displayed at checkout. Taxes, payment-provider conversion, or other legally required charges may be added or handled at checkout. An order may be cancelled and refunded if payment fails, fraud is suspected, the listed price is clearly erroneous, or the product cannot be supplied.

Updates and support

A purchase includes the files and support described on the product page at the time of purchase. Future updates, new formats, custom edits, installation, printing, and software training are not included unless expressly stated.

Part 3 — General Terms

Intellectual property and buyer-provided materials

SEKAI Designs retains ownership of its website, product previews, templates, methods, and materials except where rights are expressly transferred in writing. Buyers and clients confirm they have permission to use names, text, images, logos, and other materials they provide.

Reasonable limitations

Creative and digital products depend on third-party software, platforms, devices, printers, and services. SEKAI Designs is not responsible for issues caused solely by unsupported edits, third-party changes, buyer misuse, or services outside its control. Nothing in these terms excludes liability or remedies that cannot legally be excluded.

Changes and priority

These terms may be updated for future purchases. The version shown when an order is placed or a proposal is accepted applies to that transaction. If a signed proposal or product-specific license conflicts with these general terms, the more specific written term controls for that transaction, subject to applicable law.
